When two or more persons own real property there are three common ways to hold title jointly in South Carolina: (1) as tenants in common, (2) as joint tenants with rights of survivorship, or (3) as tenants in common with an indestructible right of survivorship; these are explained in more detail below.*
(1) Tenants in Common (“TIC”): If you take title this way each co-tenant will own percentage interest in the property, and upon the death of either/any of you, that percentage interest you owned would be disposed of according to your Last Will & Testament. If you died without a Last Will & Testament, it would go to your legal heirs according to the intestacy laws of SC. NOTE: under this choice it will be presumed that the co-tenants’ interest will all be equal unless you tell us in writing that the interests are to be divided some other way (e.g. Owner A gets 80% and Owner B gets 20%).
(2) Joint Tenants with Rights of Survivorship (“JTWROS”): If you take title as JTWROS each joint tenant would own an undivided interest in the property. Under this type of ownership, upon the death of joint tenant the surviving joint tenant(s) would be vested with 100% ownership of the property as a matter of law. However, during your lifetime, any joint tenant can sever the joint tenancy by executing a deed, thereby making it a tenancy in common discussed above.
(3) Tenants in Common with a Right of Survivorship (“TICWROS”): If you take title as TICWROS it is similar to the ownership explained in number (2) above (e.g. upon the death of one of you the surviving person would be vested with 100% ownership of the property as a matter of law); however, this joint ownership cannot be unilaterally destroyed thus requiring the joint owners to agree to any severance. Additionally, unlike JTWROS where title is conveyed equally, this ownership can be conveyed in varying percentages (e.g. Catherine & Ashley own as TICWROS with Catherine owning 90% and Ashley owning 10%). Further, this form of ownership arguably provides more protection from creditors than the form mentioned in number (2) above [see Smith v. Cutler, 366 S.C. 546, 623 S.E. 2d 644 (2005)].

Also, some brokerage companies require at least three days’ notice to remit a wire.
